The Costa del Sol, renowned for its picturesque beaches and vibrant culture, has recently introduced new tourist rental laws aimed at fostering a more sustainable and harmonious environment for both residents and visitors. These regulations, effective from April 3, 2025, present several positive developments for property owners, tourists, and the local community.

Empowerment of Local Communities

A significant aspect of the new regulations is the empowerment of residential communities. Homeowner associations now have the authority to vote on permitting or restricting short-term rentals within their buildings. Specifically, property owners must obtain approval from at least three-fifths (60%) of the community members before renting their properties to tourists. This democratic approach ensures that tourism development aligns with the preferences and well-being of local residents, fostering a balanced coexistence. ​

Streamlined Licensing Process

The removal of the First Occupation License (LPO) requirement simplifies the process for property owners to register their homes as tourist accommodations. Owners can now declare compliance with urban planning regulations without the need for additional certification, reducing bureaucratic hurdles and encouraging more property owners to enter the rental market. ​

Municipal Oversight for Sustainable Growth

Local municipalities have been granted greater authority to regulate tourist rentals, allowing them to tailor policies to their specific needs. 

As of April 3, 2025, Spain has implemented new regulations affecting short-term holiday rentals, granting Communities of Property Owners (comunidades de propietarios) significant authority over such activities.

Under these regulations, a community can prohibit or approve tourist rentals within their building or complex through a vote. Specifically, a favorable vote from at least three-fifths (60%) of the total owners, who must also represent three-fifths of the ownership shares (participation quotas), is required to make such decisions. ​

Additionally, communities have the power to impose up to a 20% increase in monthly community fees on properties engaged in short-term rentals, acknowledging the increased wear and tear on common areas. ​

It's important to note that properties with valid tourist rental licenses obtained before April 3, 2025, are exempt from these new community approval requirements. However, any new applications for tourist rental licenses submitted after this date must comply with the updated regulations, including securing the necessary community approval. For property owners in the Costa del Sol and throughout Spain, these changes underscore the importance of engaging with their respective Communities of Property Owners to understand and adhere to any specific rules or restrictions regarding short-term rentals
